Terms of Service

These terms cover your use of flyguyfishguide.com, including the AI fishing guide and online booking, and set out the deal when you book a charter with us. Using the site or booking a trip means you accept them. If anything here is unclear, just ask: nick@flyguyfishguide.com or 508-936-3474.

The AI fishing guide is advice, not gospel

• The AI guide offers fishing information and trip planning help. It is provided as-is and can be wrong. It is not a substitute for your own judgment, a licensed captain's judgment on the water, or official sources.
• Always check the official NOAA and NWS marine forecast before going out, and confirm fishing regulations with MA DMF, MassWildlife, or NOAA before keeping fish. Conditions data shown in chat is for planning only.
• Do not rely on the site or the AI guide for safety-of-life decisions.

Booking, deposits and payment

• A booking made online (through the AI guide) or directly with Captain Nick reserves a specific date. A 50% deposit reserves your date: $500 for an inshore half day, $650 for an inshore full day, or $1,200 for an offshore trip.
• Online bookings hold the date for 24 hours. If the deposit invoice is not paid within 24 hours, the hold releases automatically and the date reopens.
• Deposit invoices are issued and paid through Intuit QuickBooks' secure payment page (card or bank transfer). Intuit's own terms apply to payment processing; we never see or store your card details.
• The remaining balance is due the day of your trip. Additional anglers and additional time are billed per the rates on the pricing page. Rates may change with fuel and other costs; the rate quoted when you book is your rate.

Cancellation and weather

• Cancel 14 or more days before your trip date (Eastern time) for a full deposit refund to your original payment method. Please allow 5 to 10 business days for the refund to appear.
• Inside 14 days, deposits are non-refundable online. Contact Captain Nick directly and he will reschedule you when possible.
• If the captain calls off a trip for weather or safety, you choose: a full deposit refund or a free reschedule. The captain's safety call is final.

On the water

• Charters run aboard a USCG-licensed and insured vessel. Everyone aboard must follow the captain's safety instructions; children under 13 wear a Coast Guard-approved PFD at all times (we provide them).
• Trips are catch-and-release. Fishing licenses for guests are covered under our commercial charter license.
• Fishing involves inherent risks. To the extent permitted by Massachusetts law, Fly Guy Fish Guides, LLC is not liable for indirect or consequential damages arising from use of this website; charter operations are subject to the waivers and terms provided at booking or boarding.

The website

• Site content, including the fishing library, is ours; it is for your personal use, not for scraping or republishing.
• Do not abuse the site: no attempts to disrupt the service, evade rate limits, or make fraudulent bookings.
• We may update these terms; the current version always lives at this address with its effective date.
